STONE HARBOR – Stone Harbor Police were alerted by a citizen of a possible intoxicated driver who had driven into a parking lot on the 9400 Block of Third Avenue Sunday, July 12 at 2:57 a.m.
Police arrived on scene and observed David Judge, 23, of Philadelphia, Pa., sitting in the driver seat with the engine running. Subsequent investigation by Officer Richard Boyle led to Judge being placed under arrest for driving under the influence and his vehicle impounded. Subsequent to his arrest, Judge was found to be in possession of Alprazolam pills (Downers), a Schedule IV narcotic, and vegetation believed to be marijuana.
Judge was transported to the Stone Harbor Police Department where his breath was tested and a search warrant sought for a blood sample to be drawn due to operating a motor vehicle under the influence and possession of drugs. The search warrant was approved by the Cape May County Prosecutor’s Office and Ocean City Municipal Court Judge Richard Russell for a blood sample.
After providing blood samples at Cape Regional Medical Center, Judge was transported back to the Stone Harbor Police Department, processed, served traffic and criminal charges, and released to a friend.
Judge was charged on the following criminal and traffic summonses; possession of a schedule IV narcotic, third degree crime, possession of marijuana, under 50 grams, possession of drug paraphernalia, motor vehicle summonses for driving under the influence and possession of drugs in a motor vehicle.
This matter is pending review by the Cape May County Prosecutor’s Office.
The charges and allegations contained in the complaint are merely accusations and the defendant is considered innocent unless and until proven guilty.
