STONE HARBOR – The Borough Council added one bullet to page 100 of its employee manual on Tuesday, Aug. 6, that bans the ability of an employee to record video or audio of a nonpublic meeting or other work-related meeting with an employee’s supervisor in attendance. The new rule was adopted by resolution.
New Jersey is a single-part consent state, meaning that it is legal to record a conversation or meeting when only one party to the conversation gives consent. That will now not be allowed, not by state law, but rather by borough policy. No explanation was given for why the borough decided it needed to change its policy to explicitly deny the privilege of an employee to record a meeting or conversation.
The bullet point being added to the manual is clear that the crucial determinant is the presence or non-presence of the employee’s supervisor.
