AVALON – Beginning in 2011, several modular Avalon homes were sold by Avalon Development Group without proper state-approved home warranties. As late as 2018, four homeowners were still without the warranties, and the borough was involved in a protracted process to resolve the situation.
Borough Council approved a resolution March 25, authorizing the purchase, at the borough’s expense, of four homeowner warranties and the execution of settlement agreements with the four property owners, which should put the matter to rest. The issue led to the suspension of the developer’s license in the state, which, in turn, complicated the purchase of appropriate warranties. It also resulted in sanctions against the borough’s construction official by the Department of Community Affairs and borough hiring a special council to defend the official, who has since retired.
Assistant Business Administrator James Waldron said all property owners have agreed to the settlement, and this finally “puts the matter to rest.”
