WILDWOOD CREST – Wildwood Crest Board of Commissioners introduced Ordinance 1401, June 7, which will permit a licensed, portable vendor to have an assistant take over in the event of a fire call. 

In many municipalities, vendors who sell ice cream or operate a hot dog cart are generally required to be military veterans or volunteer firemen. State law allows municipalities to issue portable vending licenses in certain areas, such as on the beach or adjacent streets.  

Some vendors have voiced concern, at times, that they are not allowed to have someone fill in for them for restroom breaks, for example.  

Ordinance 1401 allows portable vending license holders, who are active-duty firemen, to have an assistant salesperson take over while they are attending a fire call. Otherwise, the license holder must be present.  

The assistant salesperson must comply with the provisions of Article III, Chapter 40 of the municipal code, which includes registration with the borough.
