OCEAN CITY – Gene Kalsky can breathe a sigh of relief after a New Jersey Appellate Court vacated an order to sell his Ocean City home to satisfy a $12.5 million judgment out of Arkansas.
Kalsky received an email from his attorney, Andrew Klein, Jan. 15, stating that further proceedings would be held in abeyance while an appeal of the judgment continues.
Over the summer, Kalsky faced the possibility his beachfront house could go up for sheriff’s sale to satisfy the multimillion-dollar Arkansas judgment, over an allegation he sent a fax in violation of the Telephone Consumer Protection Act to advertise his plumbing business. He pointed out at the time, even if he won his case on appeal, his house would still have been sold.
This is not a final resolution for the matter, with a motion still under consideration in a New Jersey court and an appeal underway in Arkansas.
