UPDATED: Vehicular Homicide Charges Pending in Moped Fatality

COURT HOUSE – Charles A. Nailie, 62, of Court House, appeared June 26 before Superior Court Judge Susan Maven here and his attorney, Michael Schreiber, requested a continuance to prepare a bail reduction request.
Schreiber told Judge Maven that his client is on several medications, has diabetes and is suffering from heart ailments.
Matthew Ryan Tozer, 16, was killed June 10 on Route 83 in Dennis Township when a car being driven by Nailie, 62, of Court House, struck Tozer on his moped. Nailie was arrested for driving under the influence and charged with aggravated assault by auto, driving while intoxicated and related vehicle offenses. He is in custody at the county jail in lieu of $100,000 bail.
Prosecutors said Nailie will be charged with the second degree crime of vehicular homicide in the next several weeks.
The matter was continued to July 10, at 9 a.m.
