STONE HARBOR – The following is an update to an aggravated assault investigation that occurred Nov. 7 at approximately 2:01 a.m. in the parking lot of an establishment on the 300 block of 96th Street. As previously reported, Joseph Diamond Jr. was charged for aggravated assault for kicking the victim in the head and was lodged in the Cape May County Correctional Center.
During the course of the investigation, it was learned a second subject, now identified as Daryl Edwards, 30, of Somers Point, N.J. went through the victim’s pockets while the victim was unconscious on the ground. Edwards then walked past the victim while the victim was still unconscious and appeared in respiratory distress. Edwards then drove Diamond Jr. from the scene, leaving the unconscious victim in the parking lot. Once Edwards was positively identified, it was determined there were two active traffic warrants for his arrest from Somers Point and Middle Township with bail set at $750 and $500 respectively. An additional arrest warrant from Somers Point for failure to appear on a disorderly persons charge was also located for Edwards with bail set at $500.
Based on the circumstances of the case, Municipal Court Judge Dorothy Incarvito-Garrabrant was contacted and authorized an arrest warrant be issued for Edwards for a third degree charge of endangering an injured victim. Stone Harbor Police located Edwards at his place of employment in Avalon, where he was taken into custody without incident. Edwards was transported to the Stone Harbor Police Department where he was processed. Judge Incarvito-Garrabrant was contacted and bail was set at $20,000 with no 10 percent option. Edwards was turned over to Cape May County Sheriff Officers and transported to the Cape May County Correctional Center in lieu of bail. On Dec. 2, Edwards was arraigned on his charges in Stone Harbor Municipal Court and transported back to the Correctional Center. This matter is pending review by the Cape May County Prosecutor’s Office.
The charges and allegations contained in the complaint are merely accusations and the defendant is considered innocent unless and until proven guilty.
