The Prosecutor’s Office said they would return to the grand jury with the case.
This week, Reilly, 25, of Upper Township, was again indicted for second degree death by auto and second degree violations of a law intended to protect public health and safety. That second charge relates to the allegation that Reilly was texting while driving.

The couple also faces three counts of second degree endangering the welfare of a child.
Marlon Mitchell, 47, was also indicted for third degree possession of a CDS, cocaine.
Jerry Stafford
Jerry Stafford, 27, of Wildwood, was indicted for two counts of possession of a CDS along with a count of possession with intent to distribute, each count being third degree. Stafford was allegedly intending to distribute both heroin and cocaine. The amount of cocaine, greater than .5 ounce, led to another count of possession with intent to distribute, this one second degree. Since the alleged crimes occurred within 500 feet of public property, the Wildwood Boardwalk, the indictment included a final count of second degree possession with intent to distribute, second degree.
The above individuals are only charged with the offenses and are presumed innocent until proven guilty.
