COURT HOUSE – A Cape May County grand jury handed up 20 indictments March 28. The week was unusual in that over half of the indictments included a count that was in the first or second degree.
These are the most serious crimes carrying the longest prison terms if convicted. The abbreviation CDS below stands for controlled dangerous substance.
Herbert Tozer
Herbert Tozer, 51, of Burleigh, was indicted for first-degree murder for allegedly stabbing a 45-year-old male in the neck in a motel on Route 47 in January.
The murder charge was added after the victim succumbed to the injury later in the month. Tozer was also indicted for second-degree aggravated assault, third-degree hindering apprehension, third-degree possession of a weapon for unlawful purposes, and fourth-degree unlawful possession of a weapon.
Jennyvon Vasquez, Jason Rue, Jonathan Ortiz, Jose Hernandez, Kathleen Vasquez
On Feb. 5, Wildwood police responded to a residence on Schellenger Avenue due to a report of a woman being held against her will. Following investigation, police believe that the woman and her 1-year-old child were taken from the residence to a place on Leaming Avenue. The female victim was able to escape from the second location and was located by Wildwood Crest police.
The child was recovered, and both mother and child were treated at Cape Regional Medical Center.
Five individuals have been indicted in the incident. Jennyvon Vasquez, 31, Jason Rue, 34, both of Ewing, and Jose Hernandez, 19, of Wildwood, first-degree kidnapping, second-degree aggravated assault, burglary, conspiracy and endangering the welfare of a child, as well as third-degree theft.
Both Jennyvon Vasquez and Rue were also indicted for possession of a CDS and possession with intent to distribute, each third degree.
Wildwood residents Jonathan Ortiz, 30, and Kathleen Vasquez, 49, were added to the kidnapping count and also face counts for hindering apprehension.
Dawn Corcoran
Dawn Corcoran, 45, of Lower Township, allegedly tried to board the Cape May-Lewes Ferry with 250 bags of heroin in her purse. Apparently unprepared for the security screening of her purse, Corcoran reacted by fleeing Delaware River and Bay Authority police, moving toward the woman’s restroom. She was subsequently arrested and charged.
Corcoran was indicted on third-degree possession of a CDS and possession with intent to distribute, along with a second-degree count of possession with intent within 500 feet of public property, in this case, the ferry.
Kaleb S. Caldwell
Kaleb Caldwell, 26, of Wildwood, was indicted for second-degree sexual assault and third-degree endangering the welfare of a child. In May 2016, Caldwell allegedly committed a sexual assault on a minor “at least 13 but less than 16” years old.
Robert Kaiser and Joseph Grillo
Robert Kaiser, 24, and Joseph Grillo, 25, of Burleigh, were allegedly engaged in trafficking in stolen property in both Middle and Lower townships. They were indicted for receiving stolen property and fencing, each third degree.
Andrew D’Agostino, Tony D’Agostino, and Jennifer Scott
Andrew, 35, and Tony, D’Agostino, 32, both of Green Creek, were indicted for third-degree theft and fourth-degree obstructing the administration of law.
Jennifer Scott, 36, of Villas, was named in a count for hindering apprehension for allegedly giving false information to investigators.
Robert Gittle
On Jan. 24, police executed a search warrant on a home on Forest Road in Villas. Robert Gittle, 25, was arrested for allegedly sending videos/images of suspected child pornography via the internet.
This week, Gitttle was indicted on four separate counts of second-degree endangering the welfare of a child, as well as two counts of the same charge in the third degree.
Brandon Fry
Brandon Fry, 18, of Ocean View was indicted on third-degree criminal mischief charges. Fry, with the participation of at least one 17-year-old juvenile, allegedly drove a vehicle onto the athletic fields of a school and intentionally caused $2,000 worth of damage.
Justin Doyle
Justin Doyle, 53, of Wildwood, was indicted for resisting arrest, third degree, and aggravated assault on an officer, fourth degree.
James Cotton
James Cotton, 41, of Wildwood, was indicted for possession of a CDS, fentanyl, third degree and fourth degree tampering with evidence.
William Jones III
William Jones was indicted for possession of a CDS and possession with intent to distribute on two occasions in November 2016. The indictment also claims that Jones was again involved in possession with intent to distribute in December in an incident when he was obligated to care for his infant biological daughter.
Jones was indicted on two counts of possession of a CDS and three counts of possession with intent, each third degree. The involvement of his daughter brought a second-degree count of endangering the welfare of a child.
Joseph Steiger
Joseph Steiger, 54, of North Wildwood, was indicted for robbery, second degree, and terroristic threats, third degree. Steiger allegedly used force on and threatened to kill a victim he was robbing.
Daniel Pfeifer
Daniel Pfeifer, 52, of Philadelphia, was pulled over for a DWI in a 1989 Ford flatbed truck that had been stolen. Pfeifer was indicted for third-degree theft.
Sean Parquer
Sean Parquer, 23, of Wildwood allegedly caused serious bodily harm to a female victim Dec. 12. He was indicted for second-degree aggravated assault.
Michael Willaver
At approximately 9:30 p.m., Feb. 20, Lower Township police responded to a report of a home intrusion on Fulling Mill Road in Villas. They found Michael Willaver, 36, of Villas, engaged in a dispute with two male residents of the house.
Willaver had allegedly forced his way into the home using a box cutter-style knife. He was indicted for second-degree burglary and two counts of aggravated assault, as well as third-degree resisting arrest and possession of a weapon for unlawful purposes. A final count of the indictment was for fourth-degree unlawful possession of a weapon.
Philip Martin, Melissa Macaluso
In separate indictments, Philip Martin, 56, of North Wildwood, and Melissa Macaluso, 31, of Wildwood, were indicted for possession of a CDS, third degree. In both cases the CDS was heroin.
Stephen Mayer
Stephen Mayer, of Ocean City, allegedly entered two Mercedes-Benz vehicles Feb. 7 and made off with more than $200 of moveable property. He was indicted on two counts of third-degree burglary and one-fourth degree count of theft.
Armster Morgan
Septuagenarian Armster Morgan, 73, of Wildwood, allegedly entered a residence on New Jersey Avenue on New Years Day. Encountering two females, Morgan allegedly engaged in sexual contact through the use of force. He has been indicted on two counts of fourth-degree criminal sexual contact as well a second-degree burglary.
Albert J. Nieves
Albert Nieves, 20, of Wildwood allegedly made terroristic threats against two individuals while in possession of a Ruger .44 Magnum revolver.
He was indicted for second-degree unlawful possession of a weapon and possession of a weapon for unlawful purposes, as well as third-degree counts of criminal restraint and terroristic threats. Allegedly found in possession of hollow nose bullets,
Nieves also faces a count of fourth-degree possession of a prohibited weapon.
The above individuals are presumed innocent until proven guilty.
