COURT HOUSE – Less than two weeks since Superior Court Judge Ray Batten threw out the murder indictment for George J. Carty III a grand jury on Oct. 20 handed Carty another indictment in the 1982 murder of John Attenborough,
Batten had ruled that the first grand jury was misled when it was told that tests comparing Carty’s DNA to that found at the crime scene were inconclusive. Batten also said that he had read and re-read the transcript of Carty’s statement and found nothing that he would characterize as a confession.
This time around, the case was presented to a new grand jury Tuesday by Assistant Prosecutor Matthew D. Weintraub.
Carty remains held in the Cape May County jail, on $350,000 bail. He has been there since he was arrested on Dec. 2007.
