Alleged Assault Lands Man in Jail

STONE HARBOR – Following a 911 call Nov. 7 at 2:01 a.m., Stone Harbor Police were dispatched to an establishment located in the 300 block of 96th Street for an unconscious man in the parking lot who appeared to have been assaulted. The male victim was then transported to Cape Regional Medical Center by the Stone Harbor Rescue Squad. The suspect left the area prior to police arrival.

Subsequent investigation revealed that an altercation took place between the victim and Joseph Diamond Jr., 28, of Middle Township in the rear parking lot. During the altercation, while the victim was on the ground, Diamond alledgedly kicked the victim in the head resulting in the victim losing consciousness. It was also determined that Diamond Jr. had an outstanding warrant for his arrest from Stone Harbor Municipal Court for failing to appear in reference to a disorderly persons offense.

An arrest warrant was subsequenty sought and approved by Judge Dorothy Incarvito-Garrabrant for Diamond Jr. on the charge of aggravated assault. At 8:29 a.m., Diamond Jr. turned himself in to police without incident. Diamond was placed under arrest. Judge Incarvito-Garrabrant was contacted and set bail at $25,000 with no 10 percent option. Diamond was subsequenlty processed and transported to the Cape May County Correctional Center in lieu of bail. The victim was treated and released from the hospital.
This matter is pending review by the Cape May County Prosecutor’s Office.
The charges and allegations contained in the complaint are merely accusations and the defendant is considered innocent unless and until proven guilty.
