3 – 5 Petition in Court

COURT HOUSE –– Robert “Budd” Springer and the Middle Township Regular Republican Organization filed a lawsuit in Superior Court against the township.
The lawsuit is seeking to reinstate names on a petition that would put a question on the November ballot asking voters to increase the size of township committee from three to five members.
Administrator James Alexis invalidated the names when they were submitted last month making the petition fail.
At a Sept. 17 committee meeting, Springer asked committee to put the question on the ballot regardless of the outcome of the lawsuit.
Solicitor James Pickering directed committee members not to respond, but Committeeman Steve Barry called the move a “political ploy” by Republicans trying to gain seats on the traditionally Democratic governing body.
Pickering said he believed that since the petition failed he didn’t think township committee had the power to put the question on the ballot.
According to Springer, Judge Valerie Armstrong is expected to make a decision regarding the lawsuit this week.
