Middle Introduces Food Truck Ordinance

COURT HOUSE – Middle Township Committee introduced an ordinance, Aug. 7, that would regulate transient businesses. The focus of the ordinance was on mobile food vendors, meaning food trucks.

The ordinance defines mobile food vendors and requires that such businesses can operate only after obtaining a transient merchant license. The license application includes a required certificate from the Cape May County Health Department.

The ordinance goes on to enumerate a number of requirements for food truck vendors, including providing trash receptacles, not occupying the street and sidewalk at the same time, not blocking passage of traffic, no equipment placed on streets or sidewalks, and no in-truck dining.

Mobile food vendors are also subject to various inspections. They are also not allowed to set up on public property without prior approval.

Other regulations limit the time a truck can be at a given location and sets rules for private parties or catered events.

A public hearing and vote on adoption of the ordinance is scheduled for the Sept. 6 committee meeting.
