COURT HOUSE — A Cape May County grand jury handed up seven indictments March 19.
The abbreviation CDS below stands for controlled dangerous substance. A “certain person” charge can be brought against individuals whose previous convictions bar them from having weapons.
Andrew T. Zarharchuck faces a 13-count indictment with two first-degree counts, for possession with intent to distribute marijuana in a quantity over 50 plants and maintaining and operating a CDS production facility. The indictment also contains two second-degree counts, for possession of a weapon while committing a CDS crime and certain person. The certain person charge arises from the fact that Zarharchuck was convicted in 2019 for possession of a CDS. The indictment contains four counts of possession of a CDS in the third degree, the drugs being methamphetamine, cocaine and fentanyl along with alprazolam. There are four counts for third-degree possession with intent to distribute as well. Finally, the indictment has a fourth-degree count for possession with intent to distribute drug paraphernalia.
James Cotton was indicted on one count of fourth-degree certain person due to possession of a box cutter as an individual convicted of possession with intent to distribute a CDS in 2017.
Hector Nieves was named in a two-count indictment for possession of a CDS, both counts in the third degree. The drugs were methamphetamine and buprenorphine.
Angel Velez was indicted for fourth-degree criminal mischief related to an incident in Wildwood City in January.
Benjamin Beason faces a five-count indictment, including second-degree burglary, along with three third-degree counts for theft, fencing and possession of a CDS, fentanyl. The final count was certain person in the fourth degree, possession of a knife with a 2002 conviction for possession of a CDS with intent to distribute.
Majaah Josey was indicted on one count of shoplifting in the third degree in Avalon in November.
Richard Mardanovi faces two third-degree counts for forgery and uttering a forged instrument, along with a fourth-degree count for tampering with public records.
