Indictments Filed Sept. 12

Readers are reminded that not only are all individuals listed below presumed innocent unless proven guilty, but there may also be multiple individuals who share the same name, even in the same town.

COURT HOUSE – A Cape May County grand jury handed up 17 indictments Sept. 12. 

The abbreviation CDS below stands for controlled dangerous substance.  

Ernesto Ruiz was indicted for second-degree sexual assault of a victim under the age of 13. He also faces a second-degree count for endangering the welfare of a child.

Thomas Barry faces four weapons offenses, including two for unlawful possession of a weapon and two for possession of a weapon for unlawful purpose, all counts in the second degree. The weapon was a Smith and Wesson 9mm handgun.

Celena Bastin was indicted for third-degree shoplifting and fourth-degree obstruction of the administration of law.

Louis Spivey was named in a single-count indictment for operating a motor vehicle during second license suspension, fourth degree.

Luis Astacio and George Rivera were jointly indicted for shoplifting and conspiracy to commit shoplifting, both counts in the third degree.

Dennis K. Wyatt faces a second-degree count for aggravated assault under circumstances that meet the definition of domestic violence. Wyatt is lodged at the Cape May County Correctional Facility.

William Chester and Glenda Chester were named in a six-count indictment. William Chester faces a second-degree count for endangering the welfare of a child, along with three third-degree counts for interfering with custody, burglary, and hindering apprehension. Glenda Chester faces two fourth-degree counts for hindering apprehension and obstructing the administration of law.

Tyrell Oddaely was indicted on two counts of aggravated assault, one second and one third degree, along with fourth-degree counts for contempt and obstructing the administration of law.

Jerry Tozer, Breana James, and Michelle Lynch were individually indicted for third-degree possession of a CDS. Tozer faces two counts of possession, while the others face one count each. The drugs were methamphetamine, fentanyl xylazine, and fentanyl.

Michael J. Wills was indicted on a fourth-degree count of throwing bodily fluids at a police officer in Wildwood.

Anthony Johnson faces a second-degree theft count for taking a 2021 BMW M4 automobile. Generally, a second-degree theft requires that what was taken had a worth in excess of $75,000.

Ralph Otto faces a third-degree count of escape. Otto is lodged at the Cape May County Correctional Facility.

Christopher P. Minor was indicted on two counts of endangering the welfare of a child, one in the second and one in the third degree. Both counts involved child porn. In addition, the indictment had two fourth-degree counts for tampering with evidence and obstructing the administration of law.

Robert Vile faces a single count of third-degree aggravated assault related to an incident in Ocean City in July.

Thurman Thompson was indicted for fourth-degree assault by auto after causing bodily injury while driving under the influence.
