Stone Harbor Prepares for Possible Zoning Litigation

STONE HARBOR – Stone Harbor Council passed a resolution Tuesday, Oct. 17, authorizing the award of a contract establishing a special counsel on zoning matters.

The resolution states that a “special counsel may become necessary to defend the borough in matters relative to zoning issues.”

Citizens have objected to lot grading regulations at council meetings, which they argue allowed construction of homes with pools well above street level. There has also been significant concern raised about the proposed side yard setback that has not yet been adopted.

The resolution makes clear that “no formal legal action” has taken place, but it goes on to note that the need for the special counsel is “anticipated.”
