I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law).
The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building. Members present were Mayor Clark, Deputy Mayor DeVico, Committeemember Donohue, Township Clerk Kimberly Krauss, Business Administrator Constance Mahon, Municipal Solicitor Frank Corrado, and Township Engineer Marc DeBlasio.

3. RESOLUTION– APPROVING PAYMENT FOR BILLS – BILL LIST A (General Bills) – On motion by seconded by and passed on roll call, the following resolution was adopted. NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that payment for the following bills in the amounts indicated are hereby approved: Current Acct. $858,160.49
4. RESOLUTION – APPROVING MINUTES FROM PREVIOUS MEETINGS – On motion by seconded by and passed on roll call, the following resolution was adopted. NOW, THEREFORE, BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that the following minutes are approved: Regular Meeting 08/01/2016.
5. REPORTS: The following departments have submitted their reports for the months indicated: Construction Department for the month of July; Sewer Billing for the month of July; Tax Collector for the month of July; Sterback Harbor monthly report by Tax Collector;
6. ORDINANCE NO. 1531-16 – AMENDING THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 146, THEREOF ENTITLED FLOOD DAMAGE PREVENTION – Following second reading, hearing, and consideration for adoption, Ordinance No. 1531-16 was adopted on motion by seconded by and passed on roll call. Complete Ordinance is on file in the Clerk’s Office. BE IT ORDAINED by the TOWNSHIP COMMITTEE, the governing body of the Township of Middle that Chapter 146, Section 6 entitled “Definitions” of the Revised General Ordinances of the Township of Middle be and is hereby amended to include the following: SECTION 1: COASTAL HIGH-HAZARD AREA An area of special flood hazard extending from offshore to the inland limit of a primary frontal dune along an open coast and any other area subject to high velocity wave action from storms or seismic sources. a. COASTAL A ZONE: A subject of Zone A. Specifically, that portion of the SFHA landward of Zone V (or landward of coastline without mapped Zone V) in which the principal source of flooding is coastal storms, and where the potential base flood wave height is between 1.5 and 3.0 feet. Requiring new construction in the coastal A Zone to meet the same standard as V Zone buildings protects it from a known, but unmapped, breaking wave hazard (credited under CAZ). DRY OR WET FLOODPROOFING Where removable shield to be used, a flood emergency plan shall be approved by the authority having jurisdiction and shall specify, at a minimum, the following information: storage locations of the shields, the method of installation, and attachment devices, yearly practice of installing shields, testing sump pumps and other drainage measures, and inspecting necessary material and equipment to activate or implement floodproofing. INCREASE COST OF COMPLIANCE (ICC) The coverage by standard flood insurance policy under the NFIP that provides fir the payment of a claim for the cost to comply with the state of New Jersey and the Township of Middle floodplain management laws or ordinances after a direct physical loss by flood, or the Township of Middle declares the structure to be “substantially” or “repetitively” flood damage, ICC coverage is provided for in every standard NFIP flood policy, and will help pay for the cost of floodproof, relocate, elevate or demolish the structure. SECTION 2: Any other Ordinances in conflict or inconsistent with this Ordinance are hereby repealed, to the extent of such conflict or inconsistency. SECTION 3: Should any section, paragraph, sentence or clause or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remaining portions of this Ordinance shall not be affected thereby and shall remain in full force and effect and to this end the provisions of this Ordinance are hereby declared to be severable. SECTION 4: This Ordinance shall become effective immediately upon final passage and publication, according to law.
7. ORDINANCE NO. 1533-16 – ORDINANCE AMENDING CHAPTER 218, ARTICLE VI, SECTION 27 OF THE CODE OF THE TOWNSHIP OF MIDDLE, THEREOF ENTITLED SUBDIVISION/SITE PLAN REVIEW, FILING PROCEDURES, APPLICATION FOR DEVELOPMENT FEES – On motion by seconded by and passed on roll call, Ordinance No. 1533-16 passed first reading. Second reading, public hearing and consideration for adoption will be held on 09/19/2016 at 6:00 p.m. BE IT ORDAINED by the TOWNSHIP COMMITTEE, the governing body of the Township of Middle that Chapter 218, Section 27 entitled “Application for Development Fees,” of the Revised General Ordinances of the Township of Middle be and is hereby amended to include the following: SECTION 1. Section 218-47 (7) Application for development fees shall be amended by the addition of the following: 218-47 (7f) Major Site Plan Gravel Pits. Application Fee $500.00 Escrow Fee $2000.00 SECTION 2: Any other Ordinances in conflict or inconsistent with this Ordinance are hereby repealed, to the extent of such conflict or inconsistency. SECTION 3: Should any section, paragraph, sentence or clause or phrase of this Ordinance be declared unconstitutional or invalid for any reason, the remaining portions of this Ordinance shall not be affected thereby and shall remain in full force and effect and to this end the provisions of this Ordinance are hereby declared to be severable. SECTION 4: This Ordinance shall become effective immediately upon final passage and publication, according to law.
8. ORDINANCE NO. 1534-16 – AN ORDINANCE TO AMEND THE CODE OF THE TOWNSHIP OF MIDDLE, CHAPTER 236, SECTION 236-7, SCHEDULE III – On motion by seconded by and passed on roll call, Ordinance No. 1534-16 passed first reading. Second reading, public hearing and consideration for adoption will be held on 09/19/2016 at 6:00 p.m. BE IT ORDAINED, by the Township Committee of the Township of Middle in the County of Cape May and State of New Jersey as follows: SECTION 1. Chapter 236, Section 7, Schedule III of the Code of the Township of Middle is hereby amended to read as follows: Name of Street Direction of Travel Location US Highway Rte 9 North From Wawa Driveway located approximately 300 feet North of the signalized intersection of Route 9 and Route 47 on to North Bound Route 9. SECTION 2. All other ordinances in conflict or inconsistent with this Ordinance are hereby repealed, to the extent of such conflict or inconsistency. SECTION 3. Should any section, paragraph, sentence, clause or phase of this Ordinance be declared unconstitutional or invalid for any reason, the remaining portions of this Ordinance shall not be affected thereby and shall remain in full force and effect, and to this end the provisions of this Ordinance are hereby declared to be serverable. SECTION 4. This Ordinance shall become effective immediately upon final passage and publication, according to law.
9. RESOLUTION – RENEWAL OF GRAVEL PIT PERMIT – On motion by seconded by and passed on roll call, the following resolution was adopted. WHEREAS, the several gravel pit permit renewal applications listed below have been found to be in proper form, and the fee paid in each case; and WHEREAS, the Township Committee finds and concludes that the excavation and soil removal work originally authorized has been in continuous operation during the period of the permit and has been performed in accordance with the conditions under which the original permit was granted; and WHEREAS, the Township Engineer undertook an inspection of the subject premises and has stated in his letter, “recertification is currently recommended” for the following licensees; and NOW, THEREFORE BE IT RESOLVED, that each of the following permits be and are hereby renewed for the calendar year 2016 and this permit is subject to the rules and regulations as set forth in the code of the Township of Middle known as Chapter 132: NO. NAME OF LICENSE BLOCK/LOT ACREAGE FEE 12 Pierson Properties, LLC 168 / 2 42.21 $600.00 BE IT FURTHER RESOLVED, that Gravel Pit License 12 for Block 168 Lot 2 has also been reviewed and is hereby retroactively renewed for CY 2015. FURTHER RESOLVED, that the above licenses be issued upon any and all conditions set forth by the Township Engineer in the letters attached to each license and as outlined in the code of the Township of Middle.
10. RESOLUTION – AUTHORIZING CREATION OF LIEN ON PROPERTY – On motion by seconded by and passed on roll call, the following resolution was adopted. WHEREAS, N.J.S.A. 40:48-2.13 authorizes the governing body of every municipality the power to make, enforce, amend and repeal ordinances requiring the owner or tenant of a dwelling or of lands lying within the municipality to provide for the removal or destruction of brush, weeds, debris, etc. constituting fire hazard or injurious to public health or safety and to provide for the imposition of penalties for the violation of any such ordinance; and WHEREAS, N.J.S.A.40:48-2.14 authorizes the municipality the right to place a lien against such dwelling or lands to provide for the cost of removing brush, weeds debris, etc.; and WHEREAS, the Township of Middle has adopted Ordinance No. 316-76 known as Article I of Chapter 193 of the Code of the Township of Middle “Property Maintenance”; and WHEREAS, the Township of Middle has noticed the following property owners as indicated below and furthermore these violations had not been remedied; and WHEREAS, in absence of compliance by said owners, the Township of Middle commenced and completed abatement of these violations; and WHEREAS, the Code Enforcement Officer of the Township of Middle has certified the following cost as listed. NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that it hereby impose a lien on the properties listed below as indicated. FURTHER RESOLVED, that a copy of this lien shall be filed in the Office of the Tax Collector of the Township of Middle. 11. RESOLUTION – APPOINTMENTS – CROSSING GUARDS – On motion by seconded by and passed on roll call, the following resolution was adopted. 12. RESOLUTION – SUPPORTING IMPLEMENTATION OF STATE FUNDING FOR PRESERVATION AND STEWARDSHIP OF OPEN SPACE, PARKS, FARMLAND AND HISTORIC SITES IN NEW JERSEY – On motion by seconded by and passed on roll call, the following resolution was adopted. WHEREAS, New Jersey voters approved in 2014 to support a long-term sustainable funding source for preservation and stewardship of open space, parks, farmland and historic sites in New Jersey; and WHEREAS, the Green Acres Program has helped to preserve over 650,000 acres of land and supported more than 1,100 park development projects over the past 50 years, the State Agriculture Development Committee has preserved 200,000 acres of farmland over the past 30 years; and the Historic Trust has preserved 477 historic sites over the past 45 years; and WHEREAS, funds from the voter referendum are not being allocated to fund these programs in a long-term sustainable fashion; and WHEREAS, the County of Cape May has been a direct beneficiary of, and partner to, these critical state preservation programs; and WHEREAS, substantial unmet needs remain for additional land and water protection, park development, and farmland and historical preservation, for the health and welfare of our communities and residents; and WHEREAS, it is imperative that implementation of this dedicated source of funding be established in order to:  sustain open space, farmland, and historic preservation programs  improve and ensure proper stewardship of parks, preserved lands, and historic sites  provide equitable access to quality parks and recreation in urban, suburban, and rural areas  match and leverage county, local, and private funds for these purposes  protect drinking water supplies, water quality, and alleviate costly flood damages  preserve fish and wildlife habitat and provide public access for hunting and fishing  revitalize cities and towns and the historic elements that provide character to a community  protect our quality of life and economic prosperity
NOW, THEREFORE, BE IT RESOLVED, that the Township Committee of the Township of Middle hereby supports implementation of the long-term, dedicated source of state funding for these purposes. BE IT FURTHER RESOLVED, that a certified copy of this resolution be served upon Governor Chris Christie, President of the Senate, Cape May County Legislative Delegation, all NJ Boards of Chosen Freeholders, and Municipal Clerks.
13. RESOLUTION – INSERTION OF A SPECIAL ITEM OF REVENUE (ITEM A THROUGH B) – On motion by seconded by and passed on roll call, the following resolution was adopted. (a) WHEREAS, R.S. 40A: 4-87 provides the Director of the Division of Local Government Services to approve the insertion of any Special Item of Revenue in the budget of any Municipality when such item shall have been made available by law and the amount whereof was not determined at the time of adoption of budget, and WHEREAS, said Director may also approve the insertion of an appropriation for an equal amount. NOW THEREFORE BE IT RESOLVED, that the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, hereby requests the director of Local Government Services to approve the insertion of additional items of revenue in the budget of the year 2016 in the sum of: 2015 JAG- Bulletproof Vest Protection Fund $4,002.75 BE IT FURTHER RESOLVED, that like sum be and the same is hereby appropriated under the following caption: 2015 JAG- Bulletproof Vest Protection Fund (b) WHEREAS, R.S. 40A: 4-87 provides the Director of the Division of Local Government Services to approve the insertion of any Special Item of Revenue in the budget of any Municipality when such item shall have been made available by law and the amount whereof was not determined at the time of adoption of budget, and WHEREAS, said Director may also approve the insertion of an appropriation for an equal amount. 14. RESOLUTION – AUTHORIZING GREEN CREEK VOLUNTEER FIRE COMPANY TO SOLICIT CONTRIBUTIONS ALONG BAYSHORE ROAD (cr603) ON AUGUST 27, 2016 – On motion by seconded by and passed on roll call, the following resolution was adopted. WHEREAS, the Cape May County Board of Chosen Freeholders (hereinafter “Board”) has received a written request from the Green Creek Volunteer Fire Company for permission to solicit financial contributions from the public along Bayshore Road (County Road No. 603) in Middle Township on August 27, 2016; and WHEREAS, the Board has reviewed Middle Township Ordinance No. 1009-98 (as adopted on March 2, 1998) establishing municipal policy regarding roadway solicitations by qualified charitable organizations; and WHEREAS, Public Law 1997, c. 82 (effective August 1, 1997) prescribes that a Municipal Ordinance so recognizing a charitable organization for this purpose must be accompanied by approval from this Board wherever the proposed location of the solicitation is on any county highway or intersection of a county highway; and WHEREAS, the said statute declares that this Board “shall not unreasonably withhold approval” of duly filed requests for authorization which otherwise comport with the requirements of law; and WHEREAS, this request by the Green Creek Volunteer Fire Company has been reviewed by the Cape May County Engineer who has interposed conditions of requirements as specified herein below; and WHEREAS, Public Law 1997, c. 82 provides in relevant part that the County “shall not be liable in any civil action for damages for property or personal injury resulting from a motor vehicle accident arising out of or in the course of roadway solicitations for the purpose of soliciting contributions, conducted by charitable organizations…”. NOW, THEREFORE, BE IT RESOLVED, by the Board of Chosen Freeholders of the County of Cape May, that: 1. The above recitals are incorporated herein by reference as if repeated at length. 2. Permission is hereby granted, pursuant to the terms of P.L. 1997, c. 82 and in consideration of the civil immunity provisions contained therein, for the Green Creek Volunteer Fire Company for permission to solicit financial contributions from the public along Bayshore Road (CR603), Middle Township on August 227, 2016, subject to the following conditions: a) The within-named charitable organization must comply in every respect with the requirements of Middle Township Ordinance No. 97-36 prior to undertaking the referenced roadway solicitation activity; and b) The within-named charitable organization has obtained and provided to the Board proof of liability insurance in amounts and with coverages satisfactory to the Board and specifically naming the “County of Cape May” as ADDITIONAL INSURED for any and all claims arising out of requested roadway solicitations; and
BE IT FURTHER RESOLVED, this resolution authorizes Green Creek Volunteer Fire Company to hold a “coin drop” along Bayshore Road (CR603), Middle Township on August 27, 2016 to obtain public contributions which help offset operational expenses.
15. RESOLUTION – ACKNOWLEDGEMENT OF RESIGNATION – On motion by seconded by and passed on roll call, the following resolution was adopted. BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle, County of Cape May and State of New Jersey, that the following resignation listed below, is acknowledged.

16. RESOLUTION – AUTHORIZING PURCHASE UNDER STATE CONTRACT – On motion by seconded by and passed on roll call, the following resolution was adopted. WHEREAS, there is a need to purchase twenty-one (21) 4RE Standard DVR Camera Systems for use by the Township Police department; and WHEREAS, through the State Contract Purchasing System, Contract #T-0106 – Contract #81300, these items are available; and WHEREAS, the total amount of the purchase for twenty-one (21) 4RE Standard DVR Camera Systems is $110,846.50, and funds are available as evidenced by the Chief Financial Officer’s Certification; and NOW THEREFORE BE IT RESOLVED, by the Governing Body of the Township of Middle, State of New Jersey, County of Cape May that the appropriate officials are hereby authorized to purchase twenty-one (21) 4RE Standard DVR Camera Systems as indicated above; and FURTHER RESOLVED, that the Chief Finance Officer is hereby authorized and directed to approve and forward a Purchase Order to: Advanced Electronic Design, INC.
17. RESOLUTION – AMENDING RESOLUTION 311-16 – APPOINTMENTS – NEW HIRES – On motion by seconded by and passed on roll call, the following resolution was adopted. WHEREAS, Resolution 311-16 inadvertently referenced an incorrect start date for a new hire. NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey that the following appointment on Resolution 311-16 is hereby amended as follows: NAME DEPARTMENT TITLE SALARY EFFECTIVE Mark S. 18. RESOLUTION – ACKNOWLEDGING RESIGNATION AND APPOINTMENT OF MEMBER TO TRAFFIC COMMITTEE – On motion by seconded by and passed on roll call, the following resolution was adopted. WHEREAS, the following volunteer board member has resigned and it is the intent of the governing body to fill said vacancy. 19. RESOLUTION – AWARD OF BID – MIDDLE TOWNSHIP HOME REHABILITATION PROJECT (ITEMS A THROUGH D) – On motion by seconded by and passed on roll call, the following resolution was adopted. (a) WHEREAS, it has been deemed necessary and desirable to solicit bids for the Home Rehabilitation Program for Contract No 2016-2, and WHEREAS, bids were received on July 11, 2016, and WHEREAS, it appears that the following bid submitted below represents a figure equal to the lowest bid received, which complies with specifications. NOW THEREFORE BE IT RESOLVED by the Township Committee of the Township of Middle, the governing body thereof, that the contract for the following Home Rehabilitation Programs be and hereby is awarded as described: Contract No. Awarded to: Total Bid Amount PO # 2016-2 Watson and Sons, LLC $7,300 FURTHER BE IT RESOLVED, that these awards are conditioned upon certification of availability of funds. WHEREAS, the Intergovernmental Transfer Program through New Jersey Civil Service Commission provides the opportunity for eligible New Jersey state and local government employees with permanent civil service status to transfer between local to local employment jurisdictions while maintaining their permanent status, and WHEREAS, this program promotes more efficient public service by allowing civil service jurisdictions to share talented and experienced individuals with other governmental sectors, and WHEREAS, all parties involved in the transfer (the transferring employee, the sending jurisdiction, the receiving jurisdiction, and the New Jersey Civil Service Commission) must agree to the transfer for it to be completed. A transfer is not valid until approved by the Civil Service Commission. NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey that the Governing Body of the Township of Middle does hereby acknowledge and approve the preparation of an Intergovernmental Transfer for Tom Flounders, Police Officer effective October 4, 2016 at the step 2 salary of $39,267.00. BE IT FURTHER RESOLVED, that Human Resources, and/or any other required official of the Township of Middle, is hereby authorized to process all “receiving agency” forms in connection with said transfer.
22. RESOLUTION – CLOSED SESSION – POTENTIAL LITIGATION (CAPE MAY COUNTY ANIMAL SHELTER AGREEMENT) – On motion by seconded by and passed on roll call, the following resolution was adopted. Upon adoption of this resolution and conclusion of this meeting the governing body will convene on the above referenced topic in closed session. This matter will be released to the public when the matter has been deemed resolved and the need to hear said item in closed session no longer exist. The public will be invited back into open session at the conclusion of this meeting and formal action may be taken. WHEREAS, the section of the Open Public Meetings Law, Chapter 231, P.L. 1975, permits the exclusion of the public from a meeting in certain circumstances; and WHEREAS, the Township Committee of the Township of Middle, the governing body thereof, is of the opinion that such circumstances presently exist; and WHEREAS, said Closed Session shall be held directly after this open session. NOW, THEREFORE, BE IT RESOLVED, by the Township of Middle, County of Cape May, State of New Jersey: 1.) The public shall be excluded from the discussion of an action upon the hereinafter specified matter: POTENTIAL LITIGATION (CAPE MAY COUNTY ANIMAL SHELTER AGREEMENT) 2.) WHEREAS, following public advertisement, proposals for the furnishing, installation, supply and servicing of vending machines at various township complexes, were received by the Township of Middle on August 11, 2016 at the Township Hall, and WHEREAS, it appears to be in the best interest of the Township to reject the bids and rebid the project. NOW THEREFORE BE IT RESOLVED, by the Township Committee, the Governing Body of the Township of Middle that all proposals received on August 11, 2016 are hereby rejected, and BE IT FURTHER RESOLVED that Purchasing Agent Josh Niemann, Township Clerk Kimberly Krauss and Business Administrator Constance Mahon, be and hereby are appointed to tabulate the bids to be taken on September 13, 2016 at 1:00 PM in the Middle Township Municipal Building, 2nd Floor Conference Room, 33 Mechanic Street, Cape May Court House, NJ for the following:
