WILDWOOD – One Mister Softee ice cream stand on the boardwalk has been shut down amid a lawsuit from the company claiming the operator of the stand did not pay the full royalty fees in 2016, The Press of Atlantic City reports.
A second stand, located at 3806 Boardwalk, remains open but no longer displays the Mister Softee logo.
Mister Softee Inc. sued Carl Gallucci, of West Wildwood, who operates the stands at 3118 and 3806 Boardwalk, claiming his licenses to operate both stands were terminated on July 12 due to failure to pay $1,728.54 in royalty fee obligations to the company, according to a previous report.
The company claimed they could no longer guarantee the health quality of the ice cream found at Gallucci’s stands.
Gallucci told The Press of Atlantic City that he was the subject of a “witch hunt.” He stated it was harsh and unfair for the company to claim people could get sick from his ice cream stand, the report continued.
