WILDWOOD – The Wildwood Board of Education is pleased to announce that the Appellate Division of the New Jersey Superior Court affirmed a lower court’s dismissal of the City of North Wildwood’s lawsuit against the board.
According to a release, the City of North Wildwood sued the board seeking to terminate the board’s use of the St. Simeons-by-the-Sea Episcopal Church Annex as a school facility for its pre-school and kindergarten students.
The Appellate Division agreed with Cape May County Superior Court Judge J. Christopher Gibson that the City of North Wildwood, which previously brought its claim before the Commissioner of Education, should have remained in front of the Commissioner of Education for resolution of the dispute and that it was not appropriate for the City of North Wildwood to bring the lawsuit against the board in Superior Court.
The Board of Education is hopeful that the City of North Wildwood will take this opportunity to reflect upon its action against the board, stop the lawsuits, and instead work in a collaborative manner for all of the children of the Wildwoods.
The board is also excited that its pre-school and kindergarten programs can continue without interruption at the St. Simeons Episcopal Church Annex and the board and school district staff are committed to continuing to provide a quality education to all the district’s children.
