Pool Rule Lingers

STONE HARBOR – Stone Harbor bayside homeowners who have been unable to install pools due to the “established bulkhead” setback requirements will have to wait a bit longer for relief.
The Planning Board had drafted new setback requirements based on the actual bulkhead, but the ordinance required to implement those requirements failed to gain introduction at the May 1 borough council meeting.
At issue are rules that use the more elusive “established bulkhead” line rather than the actual bulkhead as the point for measuring the setback. While many on the council said they support instituting a 5-foot setback from the actual bulkhead, portions of the current regulation allow a 30-inch vertical space above the bulkhead plate as the maximum height for the pool.
Council felt that this issue merited further consideration in light of an expected increase in the borough’s required height for the bulkhead.
