STONE HARBOR — Attorney Neil Yoskin filed an Administrative Hearing Request Dec. 24, 2008 with the Department of Environmental Protection, on behalf of Cape May County, appealing the denial of a Coastal Area Facility Review Act (CAFRA) permit to build a county library here at the 95th Street municipal parking lot.
The Division of Land Use Regulation’s Nov. 25, 2008 permit denial was based on Public Open Space and Scenic Resources and Design codes.
The denial stated parking issues would adversely affect the public’s ability to enjoy the beachfront and plans do not achieve the required setback of twice the height of the building.
Engineer Thomas Thornton, who prepared site plans for the library, said the project would result in a loss of 16 parking spaces.
The appeal states, “The department’s determination that the project will adversely affect the availability of parking and that the applicant has not demonstrated compliance with the Open Public Space Rule is arbitrary, capricious, unreasonable and otherwise not in accordance with law.”
