Motor Vehicle Stop Leads to Drug Arrest

COLD SPRING – Patrolman James McNulty of the Lower Township Police Department was conducting a property check of the Mitnick School on Seashore Road in Cold Spring July 12 at approximately 9:35 p.m.
Patrolman McNulty observed a suspicious vehicle parked behind the school. As Patrolman McNulty neared, the vehicle immediately attempted to leave the area and Patrolman McNulty initiated a traffic stop based on the suspicious activity.  
Upon Patrolman McNulty’s initial contact the front passenger was not wearing a seat belt. The front passenger, later identified as David J. Gant, 24, of Villas, was continuously demonstrating furtive movements in his seat.
Out of concern for his safety and to investigate further, Gant was removed from the vehicle. Patrolman McNulty immediately saw a blue pill on the front passenger seat.
When Gant was questioned about the pill he fled the area.
Patrolman McNulty pursued Gant on foot and approximately one to two minutes later Gant was arrested without further incident and returned to the original motor vehicle stop location. 
Gant was charged with obstructing the administration of law and possession of a prescription legend drug without prescription. 
Further investigation revealed that Gant was in possession of over a half ounce of cocaine, two doses of black tar heroin under a half ounce, and other drug paraphernalia. He was also charged with distribution of controlled dangerous substances (CDS) on or within 1,000 feet of school property. 
Warrants were issued for the above charges by Judge Hillegass who set the bail at $75,000, no 10 percent.   
In default of bail, Gant was lodged in the Cape May County Correctional Center where he is awaiting further adjudication. 
The charges and allegations contained in the complaint are merely accusations and the defendant is considered innocent unless and until proven guilty. This report is based on information received from law enforcement.
