The Constitution Must Prevail

To The Editor:
The president’s allegedly a Constitutional scholar, but we’re witnessing his lack of basic legal knowledge. Obama warns of an activist court, ironically what the left depends on when they can’t pass legislation. Obviously he has no idea what “activist court” means.
Let’s examine another example of Obama’s inep-titude. He remarked that the high court never over-turned a law passed by the overwhelming majority of a democratically-elected congress. Yes it has, and Obamacare was passed by a slim margin. He in-sinuates that there’s a problem with the judicial branch as a whole because justices aren’t elected. So? That’s how our government works. Weren’t two of these non-elected judges his selections? Will he have problems with their decision?
Some mistakenly analyze the Supreme Court as “five conservatives, four liberals.” An accurate description is “five constitutionalists, four anti-constitutionalists.” The Supreme Court’s sole pur-pose is to decide the constitutionality of law. Four aren’t doing their job. Among the anti-constitutionalists are Ruth Bader Ginsburg, a radi-cal who said Roe v Wade was not extreme enough because it acknowledged the unborn.
Obama appointed Sandra Sotomayor, who as a lower judge, made racist decisions. She merits “empathy” for a person, rather than the rule of law, guiding her decisions. Then there’s Kagen, who should have recused herself for a conflict of inter-est. Before her appointment, she was the solicitor general hired to argue for Obamacare to the Su-preme Court. Her vested interests make her inca-pable of impartiality, but a good leftist, she lacks the honor to step down. The ends justify the means. Fun fact: Kagen wrote a college thesis praising communism, and traveled overseas to tell an African country not to model their constitution after America’s because it’s obsolete. When the constitution means nothing to you, apparently it is.
Then there’s Justice Beyer, who said that activist justices should look to other countries’ precedents if American law conflicts with their agenda. He arrogantly claimed he understood the Constitution better than the Founding Fathers, a justification to rule against it.
You can distinguish constitutionalists from the anti-constitutionalists by examining their records. Justices Alito, Roberts, Thomas, and Scalia use the Constitution alone as the basis for their decisions. That’s how they’re supposed to do their job. The term judicial activism refers to those who look outside our highest law, or eschew it entirely. Yes, there are activist judges, but I’ve never seen a sitting president in my lifetime attack deliberating justices. Grow up, Obama. Most of us in the real world already learned that we can’t always get our way, and that you don’t throw tantrums at every-one else whenever you don’t.
Obama and his team have been backtracking themselves when they are actually caught in their falsehoods. Even honest liberals and the left-leaning media are directly questioning Obama’s remarks, whether or not they support health care rationing. While covering their tracks, his team only dug themselves deeper. Remember, this panicked inep-titude comes from someone who presented himself to us as a messianic figure, among history’s great-est legal minds. Instead, “Emperor Obama’s” new clothes are turning more transparent. Time for justice to prevail, and for America to subsequently replace the unqualified occupant at Pennsylvania Avenue.
