To The Editor:
On behalf of many South Dennis residents and homeowners now experiencing total neighborhood disruption, please add this to the list of the never-ending complaints involving noise, dust, and zoning problems involving ATVs in residential communities in Dennis Township.
In particular, my family is experiencing gross, unreasonable, and non-work related noise entering directly into all rooms of my home with the windows up. My home is located five houses from this property at 158 Gravel Hole Road.
Beginning at 5:05 p.m. until 6:08 p.m., multiple high performance ATVs are in operation at the property at 1583 State Highway 83. I find it interesting that the homeowner is not only able to violate zoning laws relative to the approved marine construction yard on State Highway 83, but can also violate residential zoning by storing large cranes, tractor trailers, pile drivers, etc. at the residence at 741 CR 657 (South Dennis – Court House) so that the space is available at the construction yard to build and operate the professional caliber motocross track on which they are now riding.
Dennis Township has no noise ordinance of any type which would allow direct police involvement or direct complaints which could be signed, in the combined Upper/Dennis municipal court. Interesting how this same court can be utilized by Upper Township residents who have a Nuisance Noise Ordinance on the books since Dec.13, 2010. Interesting how Dennis Township is the only municipality in Cape May County without such ordinance protections for homeowners and taxpayers.
Also interesting is how Dennis Township has not responded to correspondence dated Oct. 12, 2012 from Solicitor Michael Donohue relative to these matters in relation to zoning and planning relative to the adoption of new ordinances on July 15, 2013 and adoption of the new Master Plan on Dec. 5, 2012.
And, interesting how a 63-acre, state-owned, ATV park located at the Woodbine/ Dennis Township dividing line at CR 550 and CR 610 is not being utilized. Interesting how there are no state laws or protections for residential homeowners relative to lack of municipal oversight as is perpetuated by the Dennis Township governing body.
