CREST HAVEN – A letter from the state Attorney General (AG) accuses Cape May County Sheriff Robert Nolan of defying an Attorney General directive by renewing the county’s agreement with Immigration and Customs Enforcement (ICE).
The 287(g) agreement with ICE, known as a Jail Enforcement Model, was scheduled to expire June 30. The AG Directive prohibited counties from entering into or renewing agreements with ICE without the approval of the AG.
The letter from Veronica Allende, director of Criminal Justice, states Nolan renewed the agreement in February 2019. When contacted by the Herald in June about the approaching expiration of the agreement, Nolan, through a spokesperson, said he was reviewing all of his options.
The state requested a copy of the agreement “currently in force” between the county and ICE, along with a statement signed by Nolan as to why the agreement should remain in effect.
The AG would then decide whether to issue a directive that would prohibit officers in Cape May County “from exercising their law enforcement authority in connection with your recently renewed 287(g) agreement.”
