CAPE MAY – Cape May City Council, at a special meeting Dec. 18, 2018, settled litigation with Promenade Partners and its principal, Edward Henry. At issue was a judgment the city had gained against Henry for $125,600 due to his default on a multi-year lease in a city-owned restaurant on the Promenade. At that December meeting, council settled the actions against Henry for $40,000.
Council heard complaints at the governing body’s Jan. 15 meeting from the public concerning the settlement. Cape May resident Christine Rizzo argued that the city was too quick to reach a settlement with Henry. She stated that Henry would soon sell property that would produce more than enough to cover the original judgment.
City Solicitor Frank Corrado said that the $40,000 settlement was “the best the city could do” given Henry’s assets. Corrado explained that the upcoming sale of property involved several investors and the return to Henry would be minimal. He also pointed to the fact that the settlement amount was exactly the same as one offered to Henry three years ago by a previous administration, one which Henry rejected at the time.
