Settlement: No Affordable Housing in B1 Zone

AVALON – Avalon Borough Council approved the settlement of a non-adversarial lawsuit Dec. 12. The suit, brought by Avalon Real Estate Agency against the borough, was not opposed by the borough or its Planning Board. 
According to Assistant Business Administrator James Waldron, the settlement confirms that a proposed Avalon Real Estate Agency project within the B-1 Zoning District is not impacted by the recently-adopted borough ordinances concerning affordable housing.
According to Waldron, the mandatory set-aside in the housing ordinances is only triggered when a developer requests something via a rezoning or use variance. The new ordinances do not amend what is permitted in the zone.
