OCEAN CITY – A Herald reader inquired about the court decision related to a story published May 27, 2017 regarding Douglas Schmitt, a lifeguard with the Ocean City Beach Patrol since June 1993.
He filed a class-action complaint May 15, 2017 in Superior Court, Civil Division alleging that Ocean City engaged in systematic wage violations against its hourly-paid lifeguard employees for the vast majority of overtime hours worked.
Schmitt was described as a current lifeguard who resided in Havertown, Pa., and allegedly regularly worked overtime hours for which he was not paid by his employer, Ocean City, in violation of applicable state law.
According to information from Ocean City Solicitor Dorothy McCrosson, provided April 4, the court granted the municipality’s motion to dismiss per an order dated Sept. 21, 2017; the city’s motion was a motion to dismiss for failure to state a claim pursuant to state law.
