STONE HARBOR – Stone Harbor Borough Council moved to implement the terms of its affordable housing settlement preserving its legal immunity against suit by developers who build high-density low and moderate-income housing. It introduced its Fair Share Housing Plan ordinance Oct. 2.
The settlement requires ordinance amendments that implement a zoning overlay in the business district, a set aside across the borough, an accessory apartment program and a plan for affirmative marketing.
If a developer found it financially attractive to use them, these changes provide for options to provide affordable housing on second, or even third, floors in the business district. The changes also require a 15 percent to 20 percent set aside for affordable units in any development which contains five or more residential units anywhere in the borough.
