GREEN CREEK — An alert homeowner here told Middle Township police Wed., July 6 sometime around 6 p.m. that they heard someone in the woods behind their farm. That tip helped lead to the arrest of Herbert E. Tozer, 45, who was tracked about 100 yards into the woods.
According to a Middle Township Police Department release, the incident began at 3:56 p.m. when Class II Officer Brian Murphy made a motor vehicle stop at Sam’s Corner parking lot on Route 47.
The tan 1998 Ford Ranger was driven by Herbert E. Tozer Jr., 23, of Wildwood. His father, the elder Tozer, was the passenger. He reportedly left the vehicle and started to walk away.
When ordered by Murphy to stop, the elder Tozer ran into the woods. Murphy then summoned backup units, and stayed with the younger Tozer.
It was determined that Tozer Sr., was wanted by the Cape May County Prosecutor’s Office, and had run from police on July 5, also in the company of Tozer Jr.
The driver was issued several motor vehicle summonses, and was arrested for hindering the apprehension of another, since he allegedly provided Tozer Sr. with transportation when he knew that police wanted him.
Tozer Jr. was remanded to county jail in lieu of $500 cash bail.
With the aid of other Middle Township patrol units, Special Services Unit Officer, a Major Crime Unit detective, and county Sheriff’s Department K-9 and patrol units, the search ensued.
After about two and a half hours later, Tozer Sr. was found in the woods behind the farm by the Sheriff’s K9 unit and three Middle Township officers.
Tozer Sr., was charged with obstruction of justice and hindering apprehension.
He was remanded to county jail in lieu of $10,000 cash bail.
