AVALON – “I’m in a pickle,” Anchorage Marina Owner Travis Marshall told Avalon Borough Council June 12. “You need to step up and do the honorable thing,” he added.
Marshall’s concern stems from a portion of the 2017 settlement that ended protracted litigation between Marshall and the borough over site plans for the development he submitted for his marina property.
The settlement had 19 stipulations, Marshall said. The one that drove Marshall to the meeting requires the borough “to replace 40 linear feet of existing bulkhead and 10 linear feet of a wing wall.”
“This settlement was signed in 2017 and the borough has not yet even applied for the necessary permits,” Marshall stated. He added that the agreement required the borough to “promptly” provide the necessary funds of approximately $44,000.
Marshall said he is about to install the cul-de-sac and work will come to “a screeching halt” due to the borough’s negligence in honoring the settlement. He said that his lawyer was urging a new lawsuit. “I am tired of litigation,” he stated.
Marshall ended by appealing to the governing body “to get it done.” There was no response from any member of council.
