Judge Rules on Byron’s Lawsuit

WILDWOOD – Superior Court Judge Michael Blee made a ruling Dec. 19 regarding a motion brought by Mayor Ernie Troiano, Commissioner Anthony Leonetti, and City Administrator Christopher Fox via attorney Alain Leibman to dismiss Commissioner Peter Byron’s complaint. The request was also made for the court to mandate that Byron pay the city’s legal fees.
In a memorandum, Blee dismissed Byron’s suit but did not obligate him to pay legal fees.
Blee wrote the court did not find “that Plaintiff’s (Byron’s) actions were in bad faith solely for the purpose of harassment or was without a reasonable basis in law or equity.”
