COURT HOUSE – Middle Township Committee voted 2-1 Aug. 19 to pass a resolution of support for Sheriff Robert Nolan’s renewal of an agreement with U.S. Immigration and Customs Enforcement (ICE).
The agreement has been used for for two years. Nolan renewed it for an additional 10 years in February.
Nolan is in a dispute with the state Attorney General’s Office over his authority to enter into the agreement without first seeking state approval. The issue is likely to end up in the courts, with a challenge to the attorney general’s authority over the sheriff’s.
Committee member Michael Clark, the lone Democrat on the governing body, voted against the resolution. He called the vote “premature.” He said that it was not prudent for the municipality to take a position that calls into question the authority of the state’s attorney general with court involvement likely.
Mayor Timothy Donohue, a Republican, defended Nolan’s actions. He said that the attorney general was asking the sheriff to ignore the law.
