TRENTON – To protect vintage gun collectors from unwarranted prosecution, Assemblyman Sam Fiocchi has introduced legislation exempting antique firearms from the state’s gun laws.
“Many people from a variety of backgrounds collect vintage guns for many reasons. Some enjoy trading and selling while others are history buffs who attend national gun shows looking for another ‘treasure,’” said Fiocchi, R-Cumberland, Cape May and Atlantic. “Regardless, collectors should not face criminal prosecution or prison for possessing or transporting such a firearm that poses no danger to public safety.”
Fiocchi’s bill, A-4250, revises the definition of “antique firearm” and exempts the possession of an unloaded antique handgun from prosecution for unlawful possession of a firearm. Under current law, an “antique firearm” is defined to include only rifles and shotguns. There is a separate definition for “antique handguns.” This measure amends the law so there is one definition of “antique firearm,” which includes handguns.
