STONE HARBOR – Stone Harbor Borough Council adopted a new ordinance Nov. 6, 2018, regulating the use of drones. No one spoke for or against the ordinance at the public hearing.
Drone enthusiasts are now speaking out against the ordinance claiming that it unfairly and illegally restricts the use of unmanned aircraft. One group, NODE, which states that it represents drone users and manufacturers dedicated to fair and reasonable drone regulation, has launched a campaign to get drone advocates to oppose the Stone Harbor ordinance.
The NODE website claims that the ordinance is preempted by federal and state law. It also points to what it sees as inconsistencies whereby federal and local regulations combine to prevent flying drones above and below 400 feet.
Mayor Judith Davies-Dunhour said that the borough is aware of the complaints and has asked the solicitor to look at the ordinance in terms of its relationship to federal regulations and New Jersey law. She said she expects that the council will bring the ordinance up again for discussion at a coming work session, possibly as soon as Feb. 19.
