Does Limit Nip Free Speech?

AVALON – In a Sept. 26 council meeting, Avalon resident Martha Wright argued that the borough had acted arbitrarily when it imposed a time limit on public comment without a formal resolution. 
Wright also pointed to instances when the borough council has asked the public to maintain decorum during comments, to limit repetitive comments and to avoid negative comments directed at borough employees.
Wright claims that attempts to regulate the content of speech during public comment are violations of the First Amendment to the U.S. Constitution.
Council members did not respond to Wright’s assertion of unwarranted restrictions on constitutional rights. In recent meetings, Council member Nancy Hudanich has characterized the borough’s actions as an attempt to maintain civility in the open discussion period. For Wright that cannot come at the expense of free speech.
