AVALON – Dean Marcolongo was sworn Nov. 13, 2017 as the 22nd Cape May County Surrogate, a move that caused him to leave his position as Planning and Zoning Board solicitor for the Borough of Avalon. On Jan. 10, Avalon Borough Council decided to retain a small part of Marcolongo’s services for at least another year.
Before leaving his position with the Planning and Zoning Board, Marcolongo had guided Avalon’s litigation over low and moderate income housing obligation. A recent settlement agreement between the borough and the Fair Share Housing Center, an affordable housing advocacy group, holds open the potential to an end to such litigation but it must first be approved by the courts at what is known as a fair share hearing.
The borough decided that it made sense to retain Marcolongo’s services as a consultant for a one-year term rather than to ask a new attorney, unfamiliar with the intricacies of the litigation, to step in at this late date. The contract for professional services awarded by the council is for a maximum of $14,500 and expires at the end of 2018.
Business Administrator Scott Wahl said the borough confirmed that a sitting surrogate is allowed to consult in this manner and the borough’s use of Marcolongo in no way represents a conflict with his role as the surrogate.
