CAPE MAY – A resolution passed at the Oct. 16 meeting of Cape May City Council that affirmed a settlement between the city and the state Department of Environmental Protection (DEP). It required the city to pay a $3,000 fine for failure to meet a scheduled test for water discharged from its desalination plant.
Officials explained that the city depends on accredited outside laboratories to perform many of the required tests at its water facility. Recently the laboratory that had performed the test in question was unable to use the subcontractor it depends on, and the testing was delayed. Under DEP rules, the city could be fined $10,000, and even an appeal of such a fine could only reduce the amount by 50 percent. The $3,000 settlement was deemed the best overall resolution of the issue.
The testing was completed within nine days of the scheduled period, and the city’s Water Department is again fully compliant. Officials say they are looking into alternative contractors with the necessary state approvals to perform the tests if needed in the future.
