AVALON – On Nov. 20, Avalon Borough Council discussed a potential settlement with Avalon Real Estate Agency. The agency’s suit against the borough and the Planning Board was termed a “non-adversarial suit” by Assistant Business Administrator James Waldron. Waldron said the agency’s development plans for land in the borough represented the “first application since the COHA ordinances.” The ordinances recently adopted by the borough set up a zoning overlay program within which certain types of development would be required to include a set aside for affordable housing.
According to Waldron the borough and the Planning Board agree that the development plans put forth by the agency’s principals are not impacted by the new COHA regulations. The point of the suit was to gain the added formal agreement of the court.
An actual agenda item authorizing an agreement to the settlement was postponed until the December meeting.
