AVALON – Following a summer of complaints from property owners in 2018, Avalon implemented significant changes to its ordinance regulating construction activity.
As construction activity in the borough recovered from the 2008 financial crisis, demolition and construction projects mushroomed, leaving many property owners to argue that it was damaging their ability to enjoy their property during the summer.
In fall 2019, with the experience of one summer under the new regulations, the borough began refining the regulations with the changes incorporated into an amended ordinance adopted Jan. 8.
The principal change was a further prohibition on “any and all exterior work of any kind” on Saturdays during July and August. Landscape construction would be subject to the same limitations as other construction activity, but normal landscape maintenance is exempt.
The changes also prohibit all demolition from July 1 through Labor Day, with exceptions for approved emergency cases.
Two other areas included in the earlier regulations were tweaked. Construction information previously required to be displayed, must now be displayed so that it is “readable from the street.”
Also, the changes clarify the rules governing construction fencing for those sites which have front and back property lines facing a public street.
