WESTERLY, R.I. – A Court House man is on trial in Rhode Island for his involvement in a 2015 fatal boating collision off Westerly, R.I., The Westerly Sun reports.
Cooper Bacon, 76, a licensed captain, was piloting a 60-foot yacht, owned by Viking Sport Cruisers of New Gretna, N.J., between boat shows in Rhode Island and Connecticut Sept. 22, 2015 when he collided with a 23-foot outboard owned by Walter Krupinski, 81, of Stonington, Conn., who was fishing at the time. Krupinski sustained fatal injuries as a result of the collision.
Bacon pleaded not guilty in May to charges by the Rhode Island Department of Environmental Management’s Division of Law Enforcement for three violations – improper navigation or failure to have a lookout, failure to take action to avoid a collision, and improper overtaking of another vessel – of the U.S. Coast Guard Navigation Rules. He asserted his Fifth Amendment right against self-incrimination and did not answer any questions from the plaintiff’s attorney Feb. 6, the report continued.
Each of the three violations carries a maximum $100 fine.
