COURT HOUSE — Charles P. Kane, Jr., 35, of Villas has backed out of a plea agreement in connection with the death of 3-year-old Elijah Joseph Ulbrich, first assistant prosecutor David Meyer said on Tue., Oct. 26.
Kane allegedly assaulted Ulbrich causing a head injury on Feb. 25. Ulbrich died days later at Cooper University Hospital in Camden.
Kane was charged with aggravated assault on a juvenile, endangering the welfare of a minor and aggravated manslaughter. He was lodged in county jail unable to raise $500,000 bail.
Meyer said Kane’s lawyer notified his office that Kane would agree to the plea agreement last week. Meyer did not disclose the terms of the plea agreement. Kane was scheduled to appear in court today, but mid morning his attorney notified Meyer he “had a change of heart.”
Meyer said the case will now be presented to a Grand Jury within the next month or so. Kane could face a murder charge, Meyer said.
