Superior Court Grand Jury Indictments, May 5

COURT HOUSE – A Cape May County grand jury indicted Mihaela Reilly, 25, on two counts related to a “death by auto” incident in Upper Township. On July 21, 2014, David Loder, 76, was walking near his home in Shore Acres, a mobile-home park, when struck by Reilly’s auto headed north on Route 9. The Seaville Volunteer Fire and Rescue Company, Upper Township Rescue Squad and state police all responded at approximately 7 p.m.
Loder was crossing Route 9 at Evergreen Drive when he was struck. According to Loder’s published obituary, he was retired from Atlantic City Electric and had five children and six grandchildren.
According to the indictment, Reilly’s “reckless driving caused the death of David Loder.” Along with the count of death by auto, second degree, Reilly is charged with violation of the law to “protect public health and safety,” second degree. The allegation is that Reilly was distracted from driving because she was attempting to text when her black Ford Focus hit Loder. Reilly could face a sentence of up to 10 years if convicted on both counts.
Jacob Wyman, 26, and Priscilla Leboy, 19, both of Upper Township, face six separate counts related to a burglary and theft that occurred Jan. 29. The indictment alleges that the two unlawfully entered the home of Carolyn Jones on State Highway 49 in Upper Township and stole property in excess of $500. Wyman and Leboy are also accused of dealing in the stolen property, jewelry valued at approximately $1,000. According to police reports, approximately $800 worth of the jewelry was recovered and returned to the victim.
Wyman and Leboy are charged with burglary and theft, both third degree, and with fencing, 3rd degree, along with three counts of conspiracy related to each charge, all also third degree.
Stephon B. Miller of Woodbine was indicted for aggravated assault, third degree, and criminal contempt, fourth degree, related to an incident on March 5. The indictment charges that Miller disobeyed a restraining order made Sept. 19, 2013 and assaulted Ashley Tundal. The indictment claims that Miller manifested “extreme indifference to the value of human life.” The restraining order had been issued as part of a 2013 case of Tundal vs. Allen.
The individuals are only charged with the offenses and are presumed innocent until proven guilty.
