COURT HOUSE — Cape May County Prosecutor Robert L. Taylor announced on Fri., Oct. 29 that the Supreme Court of New Jersey had denied Dr. John Costino’s motion for leave to appeal the earlier decision of the Appellate Division that permits the jury to hear six recorded conversations between him and an undercover officer posing as an exotic dancer.
Now, the Appellate Court’s ruling permitting the use of testimony about the conversation she had with Costino about painkillers and recordings of other conversations stands.
The decision by the Supreme Court was filed on Oct. 21. Trial has been tentatively scheduled for March 2011.
