COURT HOUSE — The Middle Township Board of Zoning Adjustment will hold a special meeting this evening, Tue., Sept 27 at 5 p.m.
The subject of the meeting will be the recent decision by the New Jersey Superior Court Appellate Division. That decision remanded the 90-unit affordable housing project proposed by the Conifer Corporation back to the Township’s Zoning Board of Adjustment.
The proposed 10-acre site for the project sits adjacent to the Township’s Public Works facility as well as the Cape May National Wildlife Refuge. It has been tied up in legal proceedings for over two years.
“As of right now, the appellate court remanded it to the Zoning Board,” said Township Zoning Officer David May. He told the Herald that the purpose of this evening’s meeting is to ask the original board members if they want to appeal the appellate decision, or do what the appellate court said and take the issue back to the Zoning Board.
“The discussion will be of the alternatives that are available to the board and to discuss the procedures from here on out, based on the decision reached tonight,” said Zoning Board Solicitor Robert Fineberg.
The meeting will take place in the Township Committee Meeting Room. Due to the nature of the discussion the Board will immediately go into Executive Session. No public comment will be heard.
