OCEAN CITY – Defense attorneys Vincent Sarubbi and Rocco Cipparone Jr. filed a pre-trial motion April 17, requesting several charges against the Manco & Manco pizzeria owners, Charles and Mary Bangle, be dismissed, according to a report in The Press of Atlantic City.
The Bangles were arraigned on a 30-count tax evasion indictment in April 2014. The government alleges that the couple neglected to report more than $980,000 over a five-year period beginning in 2007 to the Internal Revenue Service.
The Bangles plead not guilty to the federal charges, which could potentially impose up to five years in prison and an additional $250,000 in fines.
According to The Press of Atlantic City, the defense has asked that 23 counts of the indictment for structuring cash deposits into the Bangles’ personal bank account be dismissed and one count of making false statements be dismissed. The Bangles claim the money represented their pay from their three Manco & Manco locations, two on the Ocean City Boardwalk and one in Somers Point.
The lawyers also requested that statements the couple made to the IRS during an unannounced May 2012 interview at their Somers Point home be excluded from the trial.
The U.S. Attorney’s Office has until April 27 to respond to the defense motions, after which a trial date will be set.
