Man Found Dead From Apparent Overdose in Wildwood Motel; One Arrested

WILDWOOD – Patrol officers from the Wildwood Police Department responded to a motel located on the 100 block of West Roberts Ave., Wildwood, for the report of an unconscious person inside one of the rooms Sept. 19 at approximately 4:40 p.m.
Upon arrival of officers, it was determined that the victim, a 59-year-old man, was deceased from an apparent heroin overdose.
During the ensuing investigation conducted by members of the Wildwood Police Department Detective Division and the Cape May County Prosecutor’s Office, Robert Luzny, 38, was charged in connection with the death.
Luzny was charged under New Jersey’s “Strict Liability for Drug-Induced Death” laws, which is a crime of the first degree and carries a maximum 20 year prison sentence. He was also charged with possession of heroin, a crime of the third degree, possession of heroin with the intent to distribute, a crime of the third degree, and possession of heroin with the intent to distribute within 1,000 feet of Wildwood High School, a crime of the third degree.
Judge Dorothy Garrabrant authorized a warrant complaint and set bail on all charges at $400,000, full cash. Luzny was unable to post bail and was subsequently lodged in the Cape May County Correctional Center.
The Wildwood Police Department will continue to utilize any legal means necessary to stem the tide of heroin and opiate related overdose deaths within the city. Wildwood Police Detectives, in cooperation with the Cape May County Prosecutor’s Office, will relentlessly pursue prosecution against those, including suppliers and dealers, responsible for every heroin and opiate related death.
Rather than going after lower-level users of heroin, law enforcement and prosecutors are seeking to take out dealers and members of the supply chain by connecting them and the drugs they sold to overdose deaths and charging them with laws that carry stiff penalties.
The name of the victim is not being released pending the notification of next of kin.
The charges and allegations contained in the complaint are merely accusations and the defendant is considered innocent unless and until proven guilty.
