COURT HOUSE – Joshua Malmgren, 33, of Middle Township, plead guilty in the death of two teen girls Sept. 2.
Defendant Malmgren plead guilty to two counts of first degree aggravated manslaughter for causing the deaths of teenage girls Ashley Dauber, 13, and Nioami Lazicki, 15, July 31, 2012. Malmgren acknowledged running over the two girls on Bayshore Rd. in Middle Township while operating his motor vehicle under the influence of alcohol and prescription medication. During Malmgren’s plea of guilty, he admitted to operating his motor vehicle with a blood alcohol content of .183, twice the legal limit in the State of New Jersey. Additionally, Malmgren noted that he had also combined the alcohol with the prescription drugs Tramadol and Clonazepam, as well as being engaged in the act of texting while driving.
As a result of Malmgren’s plea agreement, he will be sentenced Dec. 5 to two nine years in New Jersey State Prison, sentences to run consecutive to each other for a total of 18 years in New Jersey State Prison, subject to the No Early Release Act (NERA), which will require Malmgren to serve 85 percent of his sentence without the possibility for parole.
