Judge Denies Motion to Dismiss Indictment in Lozier’s Death

COURT HOUSE — According to the Press of Atlantic City, a judge Monday (Sept. 28) denied a defense motion to dismiss the aggravated manslaughter indictment against a Philadelphia man charged in the July 2008 death of 20-year-old Court House resident Craig Lozier.
The Press reported that defense attorney Carl Poplar argued that the grand jury that returned the first-degree indictment should have been given more comprehensive instructions as it considered such a serious charge.
Middle Township police, on July 21, 2008 charged the driver of a passenger car involved in the fatal motor vehicle accident, which occurred at 2:24 p.m. that day on Route 47, Court House.
Killed in the crash was Craig Lozier, 20, of Court House, who was traveling north on Route 47 on his motorcycle, and was unable to avoid the vehicle being driven by Nicholas Golden, 18 of Philadelphia.
Golden and his passenger, Kyle Zalot,18, of Philadelphia had been traveling south on Route 47 when they attempted to pass vehicles. Golden was charged with one count of death by auto, a first-degree crime. He was also charged with driving while intoxicated, and other motor vehicle charges.
Lozier was pronounced dead at the scene. Golden and Zalot were treated and released for minor injuries at Cape Regional Medical Center.
