COURT HOUSE – A Cape May County grand jury handed up the following indictments Sept. 22:
Shelly Santos, Carissa Jannotti
On July 10, at about 8:30 p.m., Stone Harbor Police responded to a call from an employee of a store on 96th Street. Told that another employee was tailing two suspected shoplifters, police stopped two women at 94th and Third Avenue.
The two were mother and daughter, Shelly Santos, 47, and Carissa Jannotti, 18, both of Maybrook, N.Y. They were in possession of numerous shoplifted items. Santos had also been seen attempting to discard items behind houses as the store employee followed.
A car belonging to Santos had been issued a ticket on 95th Street. Police, using a search warrant, entered the vehicle and found over a hundred items believed to have been shoplifted from various stores and valued at over $700.
The two were indicted for shoplifting, receiving stolen property, and conspiracy, all in the third degree as well as with hindering apprehension, a fourth degree crime. The latter charge was for concealment and destruction of evidence as Santos discarded items.
Egidijus Riaubys
Egidijus Riaubys, 22, a Lithuanian national in Avalon on an International Work Visa, was indicted for aggravated sexual assault, a first degree crime. During the early morning hours of July 26, police on routine bike patrol came upon a male allegedly assaulting an unconscious female in the 2300 block of Ocean Drive.
The victim, a 28-year-old woman from Pennsylvania, was transported to Cape Regional Medical Center, treated and later released.
Conviction for a first-degree crime can lead to imprisonment of 10 to 20 years in New Jersey State Prison.
Thomas M Borland
Thomas Borland, 31, of Philadelphia was arrested on June 20 in North Wildwood, for using force in the commission of a theft and then assaulting a police officer. Borland was indicted for robbery, second degree, aggravated assault, third degree, and resisting arrest, third degree.
Carol A. MacNeal
A Pennsylvania resident, Carol MacNeal, 45, of Lansdowne, was arrested by Cape May City police on August 8 on numerous charges. It began with a shoplifting complaint on Beach Avenue at a little past noon.
A store employee allegedly had been assaulted by MacNeal after confronting her about taking merchandise. MacNeal had fled the store. Shortly after police were called for a burglary and theft on Jackson Street.
A police officer in the Washington Street Mall was then notified that a woman had been seen checking the handles of parked cars along Congress Place.
MacNeal was found in a parked GMC Suburban in a Congress Place parking lot. She fled when police approached and was eventually apprehended in a backyard on North Street.
MacNeal was indicted for robbery, second degree, two counts of burglary, third degree, theft, fourth degree, and resisting arrest, fourth degree.
Thomas R. Karter
Thomas Karter, 53, of Wildwood was indicted for possession of a prohibited weapon and certain person, both in the fourth degree. Karter had been convicted of armed robbery in Cape May County in 1988 and was forbidden to carry a weapon, which led to the “certain person” charge. He was found in possession of a switchblade knife.
Edward Baumbach
Edward Baumbach, 47, of Villas, was indicted for aggravated assault, resisting arrest, making terroristic threats, and possession of a weapon for unlawful purposes, each a third degree charge. He was also indicted for unlawful possession of a weapon, fourth degree.
Baumbach had a confrontation with Lower Township Police on Tomlin Avenue July 20.
Eventually seven members of the police department were involved in the incident during which Baumbach allegedly threatened to kill officers and used a wooden chair and stick as a weapon.
Just two weeks prior, Baumbach had been arrested in Wildwood for disorderly conduct July 5.
Steven M. Szymborski
On Jan. 27, in Middle Township, Steven Szymborski allegedly entered two parked vehicles and took property each time valued in excess of $200. When arrested, Szymborski was found to be in possession of a Schedule IV drug, alprazolam. This week he was indicted for possession of a controlled dangerous substance, third degree, two counts of burglary, both third degree, and two counts of theft, fourth degree.
The individuals are only charged with the offenses and are presumed innocent until proven guilty.
